Terms of Service

1. Scope and Acceptance

These Terms of Service (“Terms”) govern access to and use of the platform ClipThis [https://clipthis.app] (the “Platform”) operated by Findnlink UG (haftungsbeschränkt) (“Findnlink,” “we,” “our,” “us”). By creating an account, accessing, or using the Platform, all users (“you”) agree to these Terms.

These Terms apply to all roles on the Platform, including:

• Creators: individuals who upload, sell, or monetize content (“Clips”);
• Clippers: individuals who participate, create, or purchase content;
• Brands / Advertisers: companies or individuals who launch or sponsor campaigns.

If you do not agree to these Terms, you may not use the Platform.

2. Account Registration and Eligibility

To use certain features of ClipThis, you must create an account. You agree to:

• provide accurate, current, and complete information;
• protect your login credentials and not share them;
• be fully responsible for all activity under your account.

Only one account per user is allowed. By registering, you confirm that you are at least 18 years old (or have parental consent if legally required).

Findnlink reserves the right to suspend or delete accounts that violate these Terms or applicable laws.

3. Platform Purpose

ClipThis operates as an intermediary platform that connects:

• Brands that initiate or sponsor campaigns,
• Creators and Clippers who submit and share content.

Findnlink facilitates payments and interactions between users but is not a party to agreements between Brands, Creators, or Clippers.

All transactions are made through the Findnlink account (temporarily with escrow) until a dedicated trust account is implemented.

4. Acceptable Use and Content Restrictions

You agree not to upload, post, or share any content that:

• is illegal, harmful, defamatory, discriminatory, or violates the rights of others;
• contains nudity, pornography, or “NSFW” material;
• includes viruses, scripts, or malicious code;
• attempts to scrape, copy, or extract data (e.g., using bots, crawlers, or spiders);
• interferes with or damages the operation of the Platform.

Findnlink reserves the right to remove content or suspend accounts at any time if necessary to protect users or comply with legal obligations.

5. Campaigns and Transactions

a) Campaign Creation

Brands may create campaigns that describe goals, budgets, and participation criteria. Creators and Clippers may submit or link content (e.g., TikTok videos, YouTube Shorts) in response to these campaigns.

b) Payments and Payouts

Payments are processed through Stripe, Paypal, Binance and Kiip, and temporarily held on the Findnlink account.

Findnlink acts as a payment intermediary, not as the seller of services.

Findnlink will later implement a trust (escrow) account for enhanced transparency.

All payouts to users are subject to completion of required verification (via Apify).

c) Fees

Findnlink may charge service or processing fees for campaigns or payouts. Fee details will be disclosed before a transaction is completed.

d) Refunds and Disputes

All refund or dispute requests must be made through the Platform’s support system. Findnlink will review disputes in good faith but cannot guarantee refunds once transactions are completed unless required by law.

6. Intellectual Property and Licensing

Users retain ownership of all original content they create and upload (“Clips”).

By uploading or linking content, you grant Findnlink a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your content for Platform functionality and marketing purposes.

Brands receive a limited license to use submitted content for the purpose defined in their campaign, unless otherwise agreed.

You confirm that all uploaded or linked content is your original work and does not infringe third-party rights.

7. Platform Fees and Taxes

All fees are displayed transparently at checkout or campaign setup. Users are responsible for any applicable taxes on earnings or purchases made through the Platform. Findnlink may deduct taxes or fees as required by law.

8. Liability and Disclaimers

Findnlink provides the Platform “as is” and “as available.”

We do not guarantee uninterrupted or error-free operation.

Findnlink is not responsible for user-generated content or the outcome of campaigns between Brands, Creators, and Clippers.

To the fullest extent permitted by law, Findnlink’s total liability is limited to the amount of fees paid by you in the 6 months prior to the event giving rise to the claim.

Nothing in these Terms limits liability for intent, gross negligence, or injury to life, body, or health.

9. Termination and Account Deletion

Users may delete their accounts at any time by sending an email to [email protected]. Findnlink may suspend or terminate accounts that:

• violate these Terms or applicable laws,
• engage in fraud, misuse, or harmful behavior, or
• cause damage to the reputation or operation of the Platform.

Termination does not affect any rights or obligations accrued before termination.

10. Governing Law and Jurisdiction

These Terms and any related disputes are governed by German law, excluding its conflict-of-law provisions and subject to mandatory EU consumer protection rules.

Jurisdiction: Aalen, Germany, unless otherwise required by mandatory consumer law.

11. Changes to the Terms

Findnlink may update these Terms to reflect changes in laws or services. If we make material changes, we will notify users via email or prominent notice on the Platform. Continued use after such updates constitutes acceptance of the new Terms.
